Terms of Service

These Terms of Service ("Terms") govern your access to and use of Kelola.co ("Kelola", "we", "our", or "us") applications and services, including our Android, iOS, and Web apps. By accessing or using the Services, you agree to be bound by these Terms.

1. Your Account

• You must be at least 16 years old to use the Services.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You must provide accurate and up-to-date information and keep it current.

2. Subscriptions, Billing, and Payments

Kelola does not directly process payment card data. Subscriptions and payments are handled by third-party platforms depending on where you purchase:

• Google Play Store (Android) – in-app purchases and subscriptions
• Apple App Store (iOS) – in-app purchases and subscriptions
• Paddle (Web/Desktop) – Merchant of Record for web purchases

We receive limited information such as subscription status, plan, and transaction identifiers to activate and manage your subscription. We do not receive or store full payment details.

2.1 Renewals and Cancellations

• Subscriptions renew automatically unless cancelled before the renewal date.
• Manage or cancel your subscription via the platform used for purchase (Google Play, Apple, or Paddle).
• Upon cancellation, access continues until the end of the current billing period.

2.2 Refunds

Refunds are processed by the purchasing platform and subject to its policies:

• Google Play: Typically within 48 hours subject to Google policies.
• Apple App Store: At Apple’s discretion via reportaproblem.apple.com.
• Paddle: 30-day money-back guarantee for first-time web subscribers; additional refunds per Paddle’s policies.

3. Acceptable Use

• Do not misuse the Services or attempt to access them using a method other than the interface and instructions we provide.
• Do not upload unlawful, infringing, or harmful content.
• Do not interfere with or disrupt the integrity or performance of the Services.

4. Intellectual Property

The Services, including software, designs, text, graphics, and logos, are owned by Kelola or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for your business purposes in accordance with these Terms.

5. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information, including data received from payment platforms. See our Privacy Policy.

6. Termination

We may suspend or terminate your access to the Services if you violate these Terms, create risk or possible legal exposure for us, or if we discontinue the Services. You may stop using the Services at any time and cancel your subscription via the purchasing platform.

7. Disclaimers

The Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by law, Kelola and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Services.

9. Indemnification

You agree to defend, indemnify, and hold harmless Kelola and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

10. Changes to the Services or Terms

We may modify the Services or these Terms at any time, for example to reflect changes to our practices or for legal, regulatory, or security reasons. If changes are material, we will provide notice (e.g., by email or in-app notifications). Continued use of the Services after changes become effective constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws applicable in your country of residence unless local mandatory consumer protection laws require otherwise. Disputes will be resolved in competent courts of that jurisdiction.
